1. Acceptance of Terms
By accessing or using Pheno ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Entertainment Purposes Only
Pheno is provided strictly for entertainment and informational purposes. Results generated by the Service are algorithmic estimates produced by artificial intelligence and do not constitute medical advice, professional assessment, diagnostic evaluation, or objective truth. Scores represent computational analysis based on statistical models that may contain biases and inaccuracies.
Do not use these results to make medical, surgical, or personal decisions without consulting qualified professionals.
3. Age Requirement
You must be at least 18 years of age to use this Service. By using Pheno, you represent and warrant that you are at least 18 years old.
4. Photo Upload Policy
You may only upload photos of yourself or photos for which you have obtained explicit consent from the person depicted. Uploading photos of others without their consent is prohibited and may result in account termination.
5. Biometric Data
Pheno processes facial geometry data to generate analysis results. This data is classified as biometric information under applicable laws. By using the Service, you provide informed consent to the collection and processing of this data as described in our Privacy Policy.
Your uploaded images are deleted immediately after analysis. No facial images, facial templates, or biometric identifiers are retained. Only numerical analysis results are stored.
6. AI Bias Disclosure
Our AI models are trained on datasets that may not equally represent all demographics. Results may vary in accuracy across different ethnicities, genders, and age groups. We continuously work to improve fairness but cannot guarantee equal accuracy for all users.
7. No Guarantee of Accuracy
Pheno provides no guarantee of accuracy, reliability, or completeness of results. The Service is provided "as is" and "as available" without warranties of any kind.
8. Limitation of Liability
To the maximum extent permitted by law, Pheno shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
9. Payments and Refunds
Payments are processed through Stripe and/or PayPal. All sales are final. Refunds may be issued at our discretion within 14 days of purchase if the Service failed to deliver results.
10. Prohibited Uses
You may not:
- Upload photos of minors (under 18)
- Upload photos without the subject's consent
- Use the Service for harassment, bullying, or discrimination
- Attempt to reverse-engineer, decompile, or extract algorithms
- Use automated tools to scrape or access the Service
- Resell or redistribute analysis results commercially
11. Governing Law
These Terms are governed by the laws of British Columbia, Canada. Disputes shall be resolved through binding arbitration in Vancouver, BC.
